Tariff Refund Class Actions: Essential Insights for Importers and Retailers

As a result of the U.S. Supreme Court decision invalidating the IEEPA tariffs, a growing number of plaintiffs are filing consumer class actions against importers seeking a share of any refunds or other damages.  This timely webinar will address the rising trend of these class action lawsuits – for example, the pending cases against Costco and Fabletics – including a discussion of what these lawsuits are seeking, risk factor analysis, and breaking down the legal claims presented in these suits.  The webinar will also offer an overview of consumer class action litigation and how it differs in significant ways from a typical breach of contract dispute.

Katie Burghardt Kramer, Partner at DTO Law, NY 

  • Katie Burghardt Kramer is a partner in the New York office of DTO Law, where she focuses her practice on complex commercial litigation, including consumer class action defense and cross-border litigation, along with arbitration matters.  Katie has litigated disputes in courts across the country, including state and federal courts, and has experience with various arbitration forums as well.  Her class action experience includes handling claims for false advertising, unfair competition, consumer protection, breach of warranty, and invasion of privacy.  In addition, she has significant experience handling cross-border disputes involving parties from China.  She is active in the American Bar Association International Law Section and co-chairs the International Litigation committee.  Katie is a frequent speaker on issues related to cross-border or domestic disputes.  Katie began her practice at a large international law firm in New York and is a graduate of Yale University and Stanford Law School.
